Deck Directory Terms

This is a convenience translation. The German version is the legally binding one.

1. Provider and scope

The deck directory at decksmd.app/decks is operated by Xherdi Lika, Gubitzstr. 6, 10409 Berlin, Germany (“we”, “us”). Full provider details are in the Imprint.

These terms govern viewing, downloading and studying decks from the directory — on the website, in the DecksMD app and in the Decks plugin for Obsidian. The DecksMD Pro subscription service is governed by our Terms of Service. How we process personal data is set out in our Privacy Policy.

2. What the directory offers

  • Without an account you can view deck pages with up to 20 preview cards.
  • With a DecksMD account you can download decks, open them directly in the app or the plugin, and study them on the website, for example by cramming or taking an exam. The account is free; a DecksMD Pro subscription is not required.
  • Decks marked as free on their page can be used without payment.

When you study on the website, we store neither your answers nor your results or progress. Progress that is meant to last is made in the app or the plugin, once you have added a deck there.

We decide which decks the directory contains. We may update, change or remove decks, and owe no particular selection, no updates and no particular availability. A deck you have already downloaded stays on your devices even if we remove it from the directory.

3. Your account

To download and study, you sign in on decksmd.app with your DecksMD account. The account is personal: do not share your sign-in details with others.

4. Deck licence

Decks and their compilation may be protected by copyright and as databases (§§ 87a ff. UrhG). Independently of that, you agree with us to the following rules when you download a deck, open it in the app or the plugin, or study it on the website.

You may

  • study the deck on your own devices, including through a sync service you use for your devices,
  • change your own copy for your own study.

For this we grant you a simple, non-transferable right to use the deck for private, non-commercial purposes.

You may not

  • publish, share or sell the deck or parts of it — neither as a file nor in any other form, for example as cards in another study app, as a document or on a website,
  • use the deck or parts of it to train, fine-tune or evaluate AI models,
  • use the deck commercially, for example in paid courses, as paid teaching material or in an offering of your own,
  • retrieve directory content automatically or download it in bulk, or circumvent access and download restrictions.

If a deck’s page names a different licence, such as a Creative Commons licence, that licence applies to that deck instead. Rights of third parties, for example in images, are unaffected, as is anything the law allows you anyway, such as quoting.

We expressly reserve the use of directory content for text and data mining (§ 44b(3) UrhG).

For a deck you have downloaded, this licence continues to apply in the version in force at the time of the download, even if we change these terms later.

5. Content of the decks

Decks are study aids. They may have been created with the help of AI and can contain errors, even when they read convincingly. Check important content against reliable sources.

The decks are not suitable as a basis for medical, legal, financial or otherwise risk-bearing decisions and do not replace professional advice. We give no warranty as to accuracy, completeness or fitness for any particular purpose, including passing an examination.

You can tell us about an error in a deck through the “Report this deck” link on its page.

6. Reporting infringements

If you believe a deck infringes your rights, such as your copyright, or is unlawful for another reason, write to support@decksmd.app or use the “Report this deck” link on its page. Please tell us

  • the deck, ideally with a link, and the cards concerned,
  • which right is infringed and why,
  • how we can reach you.

We review every report promptly, remove content where the report is justified, and tell you the outcome.

7. Suspension

If you breach section 4, we may block you from downloading and studying in the directory. Where possible and reasonable, we will notify you first and give you an opportunity to remedy the breach. For serious breaches, such as bulk downloading or publishing decks, we may block immediately. Further claims remain unaffected.

8. Liability

We are liable without limitation:

  • for intent and gross negligence,
  • for injury to life, body or health,
  • under the German Product Liability Act, and
  • to the extent of any guarantee we have given.

For ordinary negligence we are liable only for breach of a material contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for this type of contract.

Liability is otherwise excluded. None of this alters the burden of proof to your detriment. Your statutory rights as a consumer are unaffected.

9. Changes to these terms

We may change these terms for the future, for example for new features or a change in the law. We publish the changed version on this page; it applies to every download and study session from its publication. For decks you have already downloaded, the last paragraph of section 4 applies.

10. Final provisions

German law applies. Mandatory consumer protection provisions of the country of your habitual residence remain unaffected.

If any provision is invalid, the remaining provisions remain effective.
